Nevada Land Buying and Selling Questions
What are the typical costs of selling vacant land in Nevada?
Nevada closings are commonly handled by a title and escrow company. Buyer and seller are jointly liable for the Real Property Transfer Tax, although the contract determines the economic split; the rate is $1.95 per $500, plus $0.10 in Churchill and Washoe Counties or $0.60 in Clark County.
On $100,000, the tax is therefore $390 statewide, $410 in Churchill or Washoe, and $510 in Clark. A Security 1st schedule for Clark and Nye Counties lists a $644 standard owner’s policy and $905 escrow fee at $100,000; Clark County charges $42 per recorded document.
Using that schedule, a clean $100,000 Clark County cash sale is about $2,101 if the seller pays the transfer tax, owner’s policy, escrow, and deed recording. The illustration excludes commissions, prorations, payoffs, concessions, document preparation, special endorsements, and title-curative work.
How do I sell inherited land in Nevada?
Nevada allows a court to set aside an estate worth no more than $150,000 without full administration, and the procedure can include real property. The value is fair market value on the date of death minus enforceable liens and encumbrances, and proceedings cannot begin until at least 30 days after death.
The petition must describe every estate asset, list known liens and debts, identify heirs and devisees, and explain the valuation. After notice and a hearing, the court’s order identifies each distributee and the property assigned; that order supplies the authority needed to place the land in the successor’s name.
Nevada’s separate affidavit procedure begins after 40 days but expressly requires that the estate contain no Nevada real property, so it cannot transfer vacant land. Estates above $150,000 use probate administration; summary administration is available when the net estate does not exceed $500,000, but real-property sales remain subject to probate sale procedures.
How do Nevada water rules affect a domestic well on vacant land?
A Nevada domestic well generally qualifies for an exemption from the groundwater-permit process when it serves a single-family household and withdraws no more than 2 acre-feet per year. All Nevada water wells must still be drilled by a licensed well driller, and the State Engineer may require domestic-well registration in a designated basin.
The exemption does not guarantee that a new well may be drilled anywhere. The State Engineer may restrict additional wells where they would unduly interfere with existing wells, and a domestic well drilled after July 1, 1981 may be subject to plugging after public water becomes available within 1,250 feet, subject to the statute’s conditions.
In a priority-based restriction, Nevada law preserves only 0.5 acre-foot per year for a metered domestic well. Basin status, public-water proximity, well records, and local parcel requirements therefore materially affect the water value of undeveloped land.
Who approves a septic system for vacant land in Nevada?
Residential septic approval in Nevada is local rather than a single statewide NDEP permit. Washoe County uses Northern Nevada Public Health, Clark County uses the Southern Nevada Health District, and other counties use their county building or health authority; local rules determine soil testing, setbacks, design, and permit fees.
NDEP regulates commercial and larger onsite sewage disposal systems. An individual discharge permit may be required for systems handling more than 15,000 gallons per day, accepting non-domestic waste, using surface disposal, or operating as a cluster system serving multiple buildings.
Even within the local program, special groundwater controls can change feasibility. Pahrump is designated as a Nitrogen Management Area and requires advanced treatment systems, while commercial systems of 3,000 gallons per day or less in Clark and Nye Counties are handled locally under agreements with NDEP. A parcel’s county and groundwater area therefore control which agency and design standard apply.
