What are the typical costs of selling vacant land in West Virginia?
West Virginia closings customarily involve an attorney, often working with a title or settlement company. The deed excise charge has two county-retained parts: $1.10 per $500 of value plus a county tax of $0.55 to $1.65 per $500, depending on the county, and a separate $20 Affordable Housing Fund fee.
On a $100,000 sale, the statutory transfer charges therefore total $350 to $570 and are payable by the grantor unless the buyer accepts the deed unpaid. Published 2026 market estimates place a basic $100,000 owner’s title policy near $350 and attorney/title-company closing work around $300–$500, producing a rough seller planning range of $1,000–$1,420 when the contract assigns all three categories to the seller.
The attorney, examination, settlement, and policy charges are not a statewide tariff, so the quote and county rate control. The illustration excludes commissions, payoffs, property-tax prorations, concessions, recording-page fees, surveys, mineral-title work, and unusual title curing.
How do I sell inherited land in West Virginia?
West Virginia’s Small Estate Act uses separate limits: probate personal property may not exceed $50,000, and West Virginia probate real estate may not exceed $100,000. For the real-estate test, fair market value is presumed to be 167% of the county assessed value, excluding property already held in a nonprobate form.
A successor records the small-estate affidavit and any qualifying original will with the county commission clerk or fiduciary supervisor. The clerk’s certificate authorizes collection and administration of small personal assets, while the recorded affidavit and admitted will establish the statutory treatment of reported real estate; creditors may still bring an equity proceeding against that land within six months of the certificate when personal assets are insufficient.
An estate does not qualify if the will specifically devises real estate to be sold rather than merely granting a power of sale. Above either limit, or where title and heirship are disputed, a personal representative generally must qualify through the county probate process before a fiduciary conveyance can close.
How can severed mineral rights affect vacant land in West Virginia?
West Virginia allows the surface estate and coal, oil, gas, or other mineral estates to be separately owned and separately assessed. Once minerals are severed, possession of the surface does not become adverse possession of the mineral estate, so decades of surface ownership do not automatically restore omitted mineral rights.
The practical issue is not only royalty ownership. Historic deeds and leases may preserve access, drilling, mining, pipeline, or other surface-use rights, and the state’s rules differ by mineral and development method; for example, a horizontal-well operator must give the surface owner notice and provide a proposed surface-use and compensation agreement, while surface coal mining requires consent or deed-based authority.
A standard surface-title commitment may therefore show that the parcel is being sold without some or all minerals. County land books, recorded severance deeds and leases, WVDEP oil-and-gas maps, and coal records must be read together because a tax parcel description alone does not establish which subsurface interests convey with the vacant land.
When can streams or wetlands restrict development of West Virginia vacant land?
Work that fills, excavates, crosses, or otherwise disturbs a stream or wetland can require more than a county building permit in West Virginia. Filling waters of the United States may require a federal Clean Water Act Section 404 permit and corresponding West Virginia Section 401 water-quality certification.
The review can apply to driveways, culverts, utility crossings, bank stabilization, channel work, and the conversion of wet ground into a building pad. Where impacts cannot be avoided, a permit may require compensatory mitigation through a mitigation bank, a permittee project, or West Virginia’s In-Lieu Fee program; that cost depends on the watershed and the amount and quality of affected resource.
WVDEP’s wetland map resources are screening tools rather than parcel-specific delineations, and small headwater streams may be less obvious than mapped rivers. The buildable portion of a wooded tract can therefore change after field identification of wetland boundaries, stream channels, crossing locations, and required permit conditions.
