Washington Land Buying and Selling Questions
What are the typical costs of selling vacant land in Washington?
Washington sales usually close through an escrow professional or attorney/Limited Practice Officer, and the seller commonly pays the Real Estate Excise Tax and standard owner’s title policy. Through December 31, 2026, the state REET rate is 1.10% on the first $525,000, plus a locality-specific REET and a $5 technology fee.
For a $100,000 Spokane County example, state REET is $1,100 and the current 0.25% local rate adds $250. Washington Title & Escrow’s published schedules list $560 for a standard owner’s policy at this price and $600 per side for Spokane County resale escrow, producing a seller planning total of $2,515 if the contract assigns all four charges to the seller.
Washington rates vary by location and title/escrow provider, and qualifying agricultural or timberland uses can receive a different state REET rate. The illustration excludes commissions, payoffs, property-tax prorations, concessions, recording charges, surveys, sales tax on services, and unusual title-curative work.
How do I sell inherited land in Washington?
Washington law says real-property title vests immediately in heirs or devisees at death, subject to debts, family allowances, and administration expenses; a devisee under a will is not established until the will is probated. A personal representative granted nonintervention powers may sell and convey estate real estate without separate court approval unless the court or will restricts those powers.
Washington’s $100,000 small-estate affidavit and 40-day waiting period apply only to personal property, not vacant land. However, an inherited real-estate transfer can be documented for recording and the REET inheritance exemption with a death certificate plus letters testamentary, a probated will, trust or community-property documents, a transfer-on-death deed, or—in an unprobated inheritance—a signed lack-of-probate affidavit identifying the rightful heirs.
The inheritance documents submitted to the county treasurer must also be recorded with the county auditor. Multiple heirs, estate debts, or a disputed will can still require probate or coordinated signatures even though title technically vested at death.
Can Washington vacant land use a well without a water-right permit?
Washington’s groundwater permit exemption allows limited well withdrawals without first obtaining a water-right permit. The statutory categories include domestic use up to 5,000 gallons per day, industrial use up to 5,000 gallons per day, irrigation of no more than one-half acre of lawn or garden, and stock watering.
The exemption does not guarantee that water is physically or legally available. One exempt use of each type is allowed per project, so multiple homes in a subdivision collectively share the 5,000-gallon domestic ceiling rather than each receiving a separate allowance.
Local counties may require proof of an adequate water supply before building or subdivision approval, and watershed-specific rules or court orders can restrict new permit-exempt withdrawals. The exemption also does not waive Washington’s well-construction standards or local land-use review, so a permit-exempt well can satisfy the water-right permit question while the parcel still fails county proof-of-water, well-siting, septic-separation, or subdivision requirements.
How do Washington critical-area rules affect vacant land development?
Every Washington city and county must adopt development regulations protecting five categories of critical areas: wetlands, critical aquifer-recharge areas, frequently flooded areas, geologically hazardous areas, and fish-and-wildlife habitat conservation areas. The requirement applies even in counties that do not fully plan under the Growth Management Act.
The state framework does not impose one universal setback. Local critical-area ordinances classify the resource, establish buffers and mitigation standards, and may require wetland delineation, geotechnical work, habitat review, or a floodplain permit before a building site, road, utility crossing, or subdivision can be approved.
Frequently flooded classifications must include at least the 100-year floodplain, while geologic-hazard mapping can identify erosion, landslide, seismic, volcanic, or other risks. Because buffers can extend beyond the mapped feature, parcel acreage and apparent dry ground do not equal usable building area; the controlling standards are those of the city or county with jurisdiction.
