What are the typical costs of selling vacant land in Virginia?
Virginia closings may be handled by an attorney or a registered nonattorney settlement agent, and state law gives the purchaser the right to choose that agent. The state deed recordation tax is $0.25 per $100, a locality may add up to one-third of that amount, and the seller’s grantor tax is $0.50 per $500.
On a $100,000 sale, those taxes equal $250 state deed tax, up to $83.33 local deed tax, and $100 grantor tax. A Virginia Title Center schedule effective January 1, 2026 lists a $470 cash-purchase settlement fee, while published 2026 title-rate estimates place a $100,000 owner’s policy around $390–$450.
If the contract allocated all of those items to the seller, the planning total would be approximately $1,293–$1,353; customary allocation may leave the seller with only the grantor tax and seller-side charges. This illustration excludes commissions, payoffs, property-tax prorations, concessions, recording-page charges, surveys, and unusual title-curative work.
How do I sell inherited land in Virginia?
Virginia real estate generally passes directly to the heirs named by intestacy or to the devisees under a will, subject to estate debts. The $50,000 small-estate affidavit applies to personal property, not vacant land, so it does not create a shortcut for conveying a parcel titled solely to the decedent.
If a will directs that the real estate be sold, the executor has statutory power to convey it. Otherwise, the heirs or devisees who received title generally execute the deed, or a court-authorized fiduciary sale is used when ownership, debts, or consent prevent a direct conveyance.
Virginia also treats timing as material: an heir’s or devisee’s sale within one year after death can remain vulnerable to estate-creditor claims unless a statutory protection applies. A recorded will, list of heirs, or Virginia Real Estate Affidavit supplies the public-record link from the decedent to the people signing the sale deed; survivorship ownership and transfer-on-death deeds follow different nonprobate paths.
How can Chesapeake Bay protection rules affect vacant land in Virginia?
Virginia’s Chesapeake Bay Preservation Act operates through local ordinances in designated Tidewater localities. Those localities map Resource Protection Areas around tidal wetlands, tidal shores, connected nontidal wetlands, and tributary streams, together with a generally 100-foot landward buffer.
Development, clearing, grading, septic placement, and new impervious surface inside that protected area face stricter review than ordinary zoning alone. Resource Management Areas can extend farther inland over floodplains, highly erodible or permeable soils, steep slopes, and other land that could carry pollution toward the Bay.
The state establishes the framework, but each locality adopts maps, review procedures, and allowed exceptions. A buildable-looking parcel can therefore lose usable acreage when the local RPA line and buffer are applied, and waterfront access does not by itself establish permission for a house site, driveway, shoreline structure, or vegetation removal.
What determines whether Virginia vacant land can support a septic system?
Virginia requires a construction permit for an onsite sewage system, and approval begins with a site-and-soil evaluation. The evaluation considers slope, available area, soil horizons, permeability, seasonal water table, nearby wells, surface water, and other disposal systems; a percolation test is only one possible part of that review.
The site plan generally documents relevant features within a 200-foot radius of the proposed building or drainfield. Before permit issuance, the absorption-area perimeter ordinarily must appear on a surveyed plat, although a local health department may waive that requirement for an unaffected single lot.
Where conventional soil absorption will not work, an alternative system may be possible but can carry additional design, operating, and recorded-notice requirements. Virginia’s listed state application fee for a new onsite construction permit without private OSE or engineer documentation is $425, while local processing and private evaluation or design charges can add to that amount.
