South Carolina is an attorney-closing state: the title search, document preparation, closing, and recording must be performed under a South Carolina lawyer’s supervision. The seller is generally liable for the deed-recording fee of $1.85 per $500, which equals $370 on a $100,000 sale.
One South Carolina title agency’s 2025 schedule lists an $832 owner’s title premium at $100,000. If the seller pays that policy and the deed-recording fee, the identifiable starting cost is $1,202, before the closing attorney’s charge and the county’s separate document-recording fee.
Attorney pricing varies with title complexity and the services bundled into the closing, so there is no single statewide all-in figure. The illustration excludes commissions, prorations, payoffs, concessions, deed preparation if separately billed, surveys, endorsements, and title-curative work; the contract determines whether the seller or buyer pays title insurance and other negotiable items.
How do I sell inherited land in South Carolina?
South Carolina’s small-estate procedure now covers probate estates worth no more than $45,000 after liens and encumbrances, but the statutory affidavit expressly excludes any interest in real property. Vacant land titled solely to the decedent therefore requires another source of deed authority even when the rest of the estate is small.
A personal representative may sell the parcel if the will grants a power of sale or the Probate Code otherwise supplies authority. When that power is absent or contested, the representative can petition for a court-authorized sale, with summons and notice to the heirs, devisees, creditors, and other interested parties identified by statute.
South Carolina real property generally devolves to heirs or devisees at death subject to administration, creditor rights, and the personal representative’s power to possess or sell it. A closing attorney will therefore examine the will, appointment documents, probate filings, heirship, and any court order before accepting the fiduciary deed.
How can coastal critical-area rules affect vacant land in South Carolina?
South Carolina regulates four coastal critical areas: coastal waters, tidelands, beaches, and beach-dune systems. Docks, bulkheads, excavation, filling, grading, and other development in these areas can require authorization from the South Carolina Department of Environmental Services before local building review.
On oceanfront property, the state establishes a baseline and setback line that control where new construction and reconstruction may occur. The setback line is based on the long-term erosion rate and may not be located less than 20 feet landward of the baseline; beach-dune jurisdiction generally extends from mean high water landward to the setback line.
These lines are regulatory boundaries, not parcel setbacks inferred from a survey or tax map, and they are periodically reviewed. A parcel can remain privately owned while its practical building envelope is narrowed by the critical-area boundary, erosion-based setback, local zoning, flood rules, and onsite wastewater requirements acting together.
How does septic suitability affect vacant land in South Carolina?
South Carolina requires a Department of Environmental Services site evaluation before an onsite wastewater permit is issued for a new single-family home. The residential application fee is $150, and the evaluation considers soil texture and color, seasonal high water, restrictive layers, slope, available area, and required separation distances.
For sites above the Fall Line, the applicant must provide backhoe pits for the soil evaluation. A qualifying lot also needs room for the initial drainfield and a repair area equal to at least 50% of the drainfield’s square footage, which can make an otherwise large parcel unsuitable when wetlands, easements, wells, or setbacks occupy the usable ground.
DES issues the onsite wastewater construction permit before the local building permit can proceed. A failed conventional evaluation does not always end development, but an engineered or alternative system may require more area, design work, operating conditions, and cost, so septic approval materially affects both buildability and land value.
