What are the typical costs of selling vacant land in Ohio?
Ohio sales commonly close through a title company, with attorneys involved when contract drafting, probate, or title problems require legal work. The state conveyance fee is $1 per $1,000, and counties may add up to $3 per $1,000, producing a transfer charge of $100 to $400 on a $100,000 sale.
The 2026 filed original rate for a standard owner’s title policy is $5.80 per $1,000 through $250,000, or $580 at $100,000. A deed costs $34 for the first two pages to record, and a county may add a records-preservation surcharge of up to $5.
If the seller pays the owner’s policy and recording, an uncomplicated $100,000 cash sale has identifiable charges of about $714 to $1,019, depending chiefly on the county conveyance fee. Settlement, title-search, and deed-preparation charges are additional; the example excludes commissions, prorations, payoffs, concessions, endorsements, and title-curative work.
How do I sell inherited land in Ohio?
Ohio permits an estate to be released from administration when probate assets are $35,000 or less, or $100,000 or less when the surviving spouse is entitled to the entire estate. Unlike many simplified procedures, the court’s release order can direct the transfer of real property, so the threshold can matter directly to inherited vacant land.
Larger estates generally require appointment of an executor or administrator. When a will gives the executor power to sell, Ohio law allows a sale at public or private sale without an additional court order, subject to the will’s terms and fiduciary duties.
Without that power, an administrator or executor may need a probate-court land-sale proceeding under Chapter 2127, particularly when the sale is required to pay debts, legacies, or administration expenses. The recorded sale documents must therefore match either the release order, the executor’s power in the admitted will, or the authority granted through the court proceeding.
How can isolated wetlands affect vacant land in Ohio?
Ohio separately regulates isolated wetlands that are not under federal Clean Water Act jurisdiction. Placing fill in one generally requires authorization from the Ohio Environmental Protection Agency, so a parcel can remain subject to state wetland review even after a federal determination finds no federally regulated wetland.
Permit level depends on wetland category and acreage. A Category 1 or Category 2 wetland of one-half acre or less may qualify for a Level One general permit; larger Category 1 wetlands and Category 2 impacts above one-half acre through three acres move to Level Two review, while Category 2 impacts above three acres and Category 3 wetlands of any size receive Level Three review.
Category, impact area, alternatives, mitigation, and compensatory-wetland requirements can change the developable footprint and project cost. State application charges include a $200 fee plus $500 per acre of affected isolated wetland, apart from delineation, mitigation, engineering, and federal or local approvals.
How do severed mineral rights affect vacant land in Ohio?
Ohio allows mineral ownership to be severed from surface ownership, which means a vacant land deed may transfer the surface while another person retains oil, gas, coal, or other minerals. The recorded mineral instruments, leases, and surface-use rights determine what the surface owner actually controls.
Under Ohio’s Dormant Mineral Act, a surface owner may pursue abandonment of a severed mineral interest when no statutory “savings event” occurred during the preceding 20 years. The process requires notice by certified mail—or publication after a diligent but unsuccessful search—and an affidavit of abandonment filed 30 to 60 days after notice.
The mineral holder then has 60 days after service or publication to record a claim to preserve the interest or an affidavit identifying a qualifying savings event. Because one timely filing can preserve the mineral estate, an apparently old severance does not disappear automatically; it remains a title issue until the statutory record and notice process is completed.
