Montana Land Buying and Selling Questions
What are the typical costs of selling vacant land in Montana?
Montana closings are customarily handled by a title or escrow company, sometimes with an attorney involved. The state constitution prohibits state and local real-property transfer taxes, but a Realty Transfer Certificate must accompany the deed when it is recorded.
A standard deed currently costs $20 for the first page and $10 for each additional page to record. As a dated local planning example, Montana Title & Escrow’s published schedule effective July 1, 2021 lists a $573 owner’s policy at $100,000 and a $1,000 escrow fee that includes basic escrow services and preparation of up to three additional documents.
Using that schedule and a two-page deed, a clean $100,000 cash sale is about $1,603 if the seller pays the policy, escrow, and recording. This is not a statewide quote and excludes commissions, prorations, payoffs, concessions, special endorsements, and title-curative work.
How do I sell inherited land in Montana?
Montana’s small-estate affidavit can be used 30 days after death when the probate estate, less liens and encumbrances, does not exceed $100,000. The statute authorizes collection of money, tangible personal property, securities, and other personal-property rights; it does not itself transfer title to land.
Land held only in the decedent’s name therefore generally requires a probate appointment or a valid nonprobate transfer, such as survivorship ownership or a recorded transfer-on-death deed. Once appointed, a Montana personal representative may sell estate real property for cash or credit unless the will, the probate code, or a court order restricts that power.
The recorded deed must match the selling authority shown in the probate record. When land passes under a transfer-on-death deed, the beneficiary records the death-related documentation and files the Realty Transfer Certificate required when ownership changes after the owner’s death.
What water-use limits apply to an exempt well on Montana land?
A Montana groundwater development using 35 gallons per minute or less and no more than 10 acre-feet per year may qualify for an exception from the water-permit process. Two or more wells or developed springs drawing from the same source can be treated as a combined appropriation; combined use above 10 acre-feet requires a permit regardless of flow rate.
For covered new groundwater uses beginning January 1, 2026, the appropriator must submit a Notice of Intent to Appropriate Groundwater before putting the water to use. DNRC’s published filing fee is $400, and an authorized notice gives the owner five years to complete the development and submit the completion notice needed for a groundwater certificate.
An exempt well is therefore not the same as unregulated water. Parcel divisions, multiple planned homes, nearby wells, and the source aquifer can determine whether one proposed well remains within the exception or becomes part of a combined appropriation.
When does Montana sanitation review apply to a land division?
Montana’s sanitation-in-subdivisions review generally applies when a division creates one or more parcels containing less than 20 acres, excluding public roadways. DEQ reviews the proposed water supply, sewage disposal, solid-waste disposal, and storm drainage before the new parcels are created.
Approval is documented in a Certificate of Subdivision Approval, or COSA. DEQ states that most lots created after 1961 that are under 20 acres will have either a COSA or recorded sanitary restrictions; the approved lot layout identifies the authorized well and drainfield arrangement.
Well locations commonly carry a 100-foot isolation zone, and a well may have to be drilled at the location or within the drilling area shown on the approved layout. A parcel larger than 20 acres may be outside this state review definition, but local subdivision rules and separate water, wastewater, or building requirements can still apply.
