What are the typical costs of selling vacant land in Massachusetts?
Massachusetts uses attorney-directed real estate closings. The state treats important conveyancing and closing functions as the practice of law, although the contract still determines which party pays the closing attorney, owner’s title policy, deed preparation, and recording charges.
Outside Barnstable County, the deed excise is $2.28 per $500, or $456 on a $100,000 sale, and is paid by the person signing the deed. The statewide deed recording fee is $155. One Massachusetts provider lists a $550 cash closing fee and $275 deed-preparation fee, while a 2026 insurer schedule prices a basic owner’s policy at $4.25 per $1,000, or $425 at this sale price.
Those published items total $1,861 on a clean $100,000 cash sale if the seller pays all five. The actual contract often allocates some to the buyer; the figure excludes commissions, prorations, liens, concessions, and title-curative work.
How do I sell inherited land in Massachusetts?
Massachusetts voluntary administration is available only when the probate estate consists entirely of $25,000 or less in personal property, excluding one motor vehicle, and at least 30 days have passed. Because the procedure excludes real estate, inherited land in the decedent’s sole name normally requires formal or informal probate.
An appointed personal representative can sell land without obtaining a separate license when the probated will contains a power of sale. A license to sell is still required for an intestate estate or when the will does not grant that power.
The closing record therefore turns on the deed, will, probate decree, letters of authority, and either the will’s sale power or the court-issued license. Massachusetts also has both recorded land and Land Court registered land, so the resulting fiduciary deed must be filed in the title system that governs the parcel.
How can wetlands or a river affect the usable area of Massachusetts land?
Massachusetts local conservation commissions administer the Wetlands Protection Act under state minimum standards. Work within a wetland resource area or its commonly regulated 100-foot buffer zone may require a Request for Determination or Notice of Intent before clearing, grading, filling, building, or installing utilities.
Perennial rivers and streams have a separate Riverfront Area. In most municipalities it extends 200 feet from each side of the mean annual high-water line; specified densely developed municipalities use a 25-foot area. Riverfront review applies performance standards rather than creating an additional buffer around that area.
Local wetlands bylaws can be stricter than the state rules. On vacant land, the field-delineated wetland edge, river status, floodplain, and municipal setbacks can reduce the practical development envelope far beyond the water visible on an assessor or listing map.
How does Title 5 affect vacant land in Massachusetts?
Massachusetts Title 5 governs onsite sewage systems where public sewer is unavailable. New construction requires a soil-suitability assessment, deep observation holes, a percolation test, an engineered system design, a local disposal-system construction permit, and a certificate of compliance after installation.
The state code generally prohibits use of soils with percolation rates slower than 30 minutes per inch, and local boards of health may impose a stricter limit. Design also depends on soil depth, high groundwater, required separation distances, daily flow, and room for both the soil absorption system and reserve area.
An old passing perc test does not itself authorize construction, although Title 5 does not impose a statewide expiration date on perc and deep-hole results. Municipal rules may limit their validity, and the final approved design determines how much of a vacant parcel remains available for a home, well, driveway, and setbacks.
