Maryland Land Buying and Selling Questions
What are the typical costs of selling vacant land in Maryland?
Maryland closings are commonly conducted by a licensed title insurance producer or attorney. The state regulates title premiums, but settlement fees vary, and the purchase contract determines which party pays the owner’s policy and how transfer and recordation taxes are divided.
Maryland’s state transfer tax is 0.5%, or $500 on a $100,000 sale. County transfer and recordation taxes vary sharply: at that price, Allegany County’s published rates produce another $500 transfer tax and $700 recordation tax, while Baltimore City’s produce $1,500 and $1,000, respectively. A $40 recording surcharge also applies.
If the seller pays all of those government charges, the same clean $100,000 cash sale totals approximately $1,740 in Allegany County versus $3,040 in Baltimore City, before title, settlement, deed, and base recording fees. It excludes commissions, prorations, payoffs, concessions, and curative work.
How do I sell inherited land in Maryland?
Maryland classifies an estate as small when property subject to administration is worth $50,000 or less, or $100,000 or less when the surviving spouse is the sole heir or legatee. A small estate uses a shorter probate procedure, but the register of wills still appoints a personal representative and issues authority to administer estate assets.
Maryland law allows a personal representative to sell, mortgage, exchange, or lease estate property, subject to the will, statutory duties, and any court restrictions. That power permits inherited land to be sold from the estate when the representative has been properly appointed.
If the property passed outside probate through survivorship, a trust, or another valid recorded mechanism, that chain controls instead. Otherwise, the will, small- or regular-estate petition, letters of administration, and representative’s deed provide the factual record showing who can convey the land.
How can Maryland’s Critical Area rules affect vacant land?
Maryland’s Chesapeake Bay and Atlantic Coastal Bays Critical Area generally covers land within 1,000 feet of tidal waters and tidal wetlands. Counties and municipalities administer mapped Critical Area programs under state standards, creating an additional layer beyond ordinary zoning.
Within the Critical Area, a protected Buffer of at least 100 feet extends landward from tidal waters, tidal wetlands, and tributary streams. The Buffer may expand for steep slopes, highly erodible soils, hydric soils, wetlands, and other sensitive features. New structures, clearing, grading, and lot coverage are restricted, with limited exceptions and mitigation requirements.
A parcel inside the 1,000-foot area is not automatically unbuildable, but its classification and Buffer can move or reduce the development envelope. Existing lot status, grandfathering, vegetation, shoreline conditions, septic placement, and local Critical Area maps determine the usable area.
When does Maryland’s Forest Conservation Act apply to vacant land?
Maryland’s Forest Conservation Act generally enters the development process when an owner seeks a subdivision, grading permit, or sediment-control approval on a tract of 40,000 square feet or more. Local governments administer most reviews under state-approved programs.
The application commonly requires a forest stand delineation showing existing forest, specimen trees, streams, wetlands, steep slopes, soils, and other priority areas. A forest conservation plan then identifies what will be retained, cleared, protected, or replanted. Clearing above the applicable threshold can create reforestation or afforestation obligations.
The Act does not prohibit every clearing project, and agricultural and other statutory exemptions may apply. On wooded vacant land subject to development review, however, retained forest and priority-resource areas can change the layout of lots, roads, utilities, stormwater facilities, and the net acreage available for construction.
