Illinois Land Buying and Selling Questions
What are the typical costs of selling vacant land in Illinois?
Illinois sales commonly combine an attorney’s legal work with a title company’s title, escrow, and settlement services. Attorney fees and the division of title charges are contractual; counties and some municipalities add transfer taxes beyond the state tax.
The Illinois transfer tax is 50 cents per $500, or $100 on a $100,000 sale. A county may add 25 cents per $500, or $50 at that price. One current title schedule lists a $278 owner’s policy at $100,000, while another Illinois/Iowa schedule lists a $400 cash closing fee and $225–$275 title search.
Using those published charges, a clean $100,000 cash sale produces approximately $1,050–$1,100 before the seller’s attorney fee and any municipal transfer tax. The estimate excludes commissions, prorations, liens, concessions, special endorsements, and curative title work.
How do I sell inherited land in Illinois?
Illinois permits an independent estate representative to sell real property without obtaining a separate court order unless the will, the representative’s appointment, or a court order limits that power. A supervised representative generally proceeds under court supervision, so the estate’s letters and administration type directly affect the sale process.
Illinois also has a small-estate affidavit for estates with a gross value of no more than $150,000, but the affidavit is limited to personal property. It does not itself transfer or establish authority to deed inherited land.
When real estate remains in the decedent’s name, the closing needs a recordable basis showing who can convey it: commonly a deed from an authorized representative during probate or deeds from the legally established heirs or devisees after the estate’s interest has passed. The will, letters of office, heirship findings, and any applicable court orders determine which route applies.
When does splitting Illinois land require a subdivision plat?
Illinois’s Plat Act generally treats a division into two or more parts as a subdivision when any resulting parcel is less than five acres. A qualifying subdivision must be surveyed, platted, approved where required, and recorded before the lots are conveyed.
Important statutory exceptions include divisions in which every resulting parcel is five acres or larger and no new streets or access easements are created. The Act also contains a limited one-time exception for creating a single parcel under five acres when the division is properly surveyed; a later division does not automatically receive the same treatment.
Counties may adopt a lower acreage threshold, down to two acres, and local zoning, road-access, utility, and health requirements still apply even when a split is exempt from the state plat definition. Prior divisions of the parent tract therefore matter when deciding whether a proposed deed creates a lawful buildable lot.
How is septic approval handled for vacant land in Illinois?
Illinois regulates private sewage systems under statewide public-health standards, but local health departments perform much of the permitting and inspection work. Approximately 90 local health agencies administer the program for individual properties.
Systems that discharge no wastewater to the surface and treated-effluent systems with a design flow of 1,500 gallons per day or less fall within the state private-sewage program. Soil conditions, seasonal groundwater, slope, setbacks, lot configuration, and the proposed building’s design flow determine the system type and required absorption area.
A parcel’s size by itself does not establish septic feasibility. The local permit and site evaluation determine whether a conventional field fits, whether an alternative design is needed, and where the system must remain separated from wells, property lines, drainage features, and buildings. Land that cannot meet those standards may require public sewer or may not support the proposed use.
