What are the typical costs of selling vacant land in Georgia?
Georgia is an attorney-closing state: a Georgia lawyer must control the closing process and oversee the execution of documents that convey title. That does not mean the seller always pays the entire legal bill; the purchase contract determines how attorney, title, and settlement charges are allocated.
Georgia’s transfer tax is $1 for the first $1,000 and 10 cents for each additional $100, which equals $100 on a $100,000 sale. A Georgia firm’s 2026 cash-purchase schedule lists a $599 attorney fee, $225 title exam, and $15 incoming-wire fee, before title insurance and optional charges.
If the seller pays those ordinary closing items, a clean $100,000 cash sale supports a $950–$1,600 planning range including transfer tax and basic title coverage. It excludes commissions, prorations, payoffs, concessions, additional deeds, mail-away signing, and title-curative work.
How do I sell inherited land in Georgia?
Georgia estate real property remains under the personal representative’s title for administration until the representative assents to its transfer to heirs or beneficiaries. For real property, that assent should be evidenced in writing; an informal family agreement does not replace it in the title record.
If the representative lacks authority under the will or appointment to sell the parcel, Georgia’s statewide probate forms provide a Petition of Personal Representative for Leave to Sell Property. The closing therefore turns on whether the estate has produced written assent or a representative with authority to execute the deed.
An heir or beneficiary may seek to compel assent after one year from the representative’s qualification, subject to the statute’s conditions. The appointment date, will, letters, court orders, and any recorded assent are the factual documents that establish whether inherited land is ready to convey.
How can septic rules affect vacant land in Georgia?
For Georgia land without public sewer, septic suitability depends on soil and usable area rather than acreage alone. State public-health guidance requires suitable ground for both the initial onsite system and a complete replacement system.
Georgia recommends at least one-half acre with public water and one acre with an individual well for a typical three- or four-bedroom home, but county boards of health set the applicable minimum lot sizes. Shallow soil, slow permeability, high groundwater, steep ground, or environmentally sensitive areas can require more land or an advanced treatment system.
The recommendation is not an automatic approval. A county soil evaluation and permit tied to the proposed homesite determine whether the parcel can support the intended bedroom count and where the protected initial and replacement areas must remain undisturbed.
How can a stream on Georgia land affect the usable building area?
Georgia generally protects a 25-foot buffer along intermittent and perennial streams and a 50-foot buffer along trout streams under its erosion-and-sedimentation rules. The buffer is measured from the streambank and can reduce the area available for a driveway, homesite, septic field, or grading.
Land disturbance of one acre or more, or work within 200 feet of a perennial stream, requires an approved erosion-and-sediment-control plan. Work inside a protected buffer commonly requires a variance unless a stated exemption applies.
Stream location and classification can therefore change the usable footprint of a narrow or irregular tract even when the full acreage transfers at closing. A map line is not always the final field boundary, but the applicable buffer follows the regulated stream as it exists on the ground.
