California Land Buying and Selling Questions
What are the typical costs of selling vacant land in California?
California generally closes through escrow, but the provider and customary fee split vary by county. Title-company escrow is more common in Northern California, independent escrow is common in Southern California, and local custom determines who pays escrow and the owner’s title policy.
The basic county documentary transfer tax is $0.55 per $500, or $110 on a $100,000 sale. Some cities impose an additional transfer tax—sometimes much larger—so $110 is only the county baseline, not a universal total.
For a clean $100,000 cash sale outside a city with an added tax, ordinary seller-paid escrow, title, and county transfer charges commonly warrant a $1,100–$2,200 planning allowance. California does not set one statewide package price; the example excludes commissions, prorations, payoffs, concessions, and unusual title work.
How do I sell inherited land in California?
California’s ordinary small-estate affidavit is for personal property and cannot transfer land. For deaths on or after April 1, 2025, the separate Affidavit re Real Property of Small Value can be used when the gross value of all California real property in the estate does not exceed $69,625.
That affidavit cannot be filed until six months after death and requires an inventory and appraisal completed by a probate referee. The much higher $750,000 simplified threshold applies only to a qualifying primary residence, so it ordinarily does not help with a separate vacant parcel.
Vacant land above the $69,625 real-property limit generally requires another succession petition, a spousal-property procedure, trust or survivorship transfer, or formal probate. The applicable value is tied to the date of death and statutory procedure, not simply the later contract price.
How can California fire-safety rules affect vacant land?
California’s State Minimum Fire Safe Regulations apply to covered development in State Responsibility Areas and certain Very High Fire Hazard Severity Zones. They address emergency access, road and driveway dimensions, address signs, firefighting water supplies, fuel modification, and vegetation management.
For a vacant parcel, the limiting issue may be the route to the homesite rather than the homesite itself. A long dead-end road, narrow bridge, steep grade, inadequate turnaround, or lack of approved firefighting water can require improvements or restrict development intensity.
Local jurisdictions may adopt standards that meet or exceed the state minimums, and the parcel’s current hazard-zone designation matters. A fire-hazard map can therefore change the physical improvements needed before a building permit is practical.
How can the California Coastal Act affect undeveloped land?
Development within California’s coastal zone generally requires a coastal development permit unless an exemption applies. “Development” is broader than constructing a house and can include grading, land division, changes in land use, vegetation removal, and work affecting coastal access.
Permit authority may sit with the city or county under a certified Local Coastal Program, or with the Coastal Commission in retained-jurisdiction and appeal areas. Setbacks, bluff stability, habitat, wetlands, visual resources, hazards, and public access can reduce the portion of a parcel that can be disturbed.
The coastal-zone boundary does not follow a uniform distance from the ocean, so proximity alone is not the test. The governing map, Local Coastal Program designation, and prior permit history are part of a coastal parcel’s development profile.
